    Sounds like he'd contacted them.

    I thought that might be the case, but I certainly wouldn't accept a helpline answer.

    The legislation makes it clear that it depends on where in income tax legislation it is taxed determines whether it is income.

    hi all yes after many phone calls and call backs it has been said that it doesn't count as income. and the other day i received my final tax credit award for 13/14 and they has removed the amount i get from the PHI.

    but as you know there are exceptions to this rule

    I think you are talking about the general rule that if it is taxable then it is income for tax credits. There are exceptions to that rule.

    But the actual legislation is structured in such a way to list out everything that counts as income and then it specifically excludes certain things. That is where you get confirmation of whether something counts or not.

    I would suggest you make a note of your phone call with the helpline in case it later turns out you were given incorrect advice.

    Not all PHI's will be excluded as income, it really depends on what section of the tax legislation they are taxed under or exempted from tax for.

    yes thanks already done that listed the person my wife spoke to there name and time of the call. As i said tnhey have sent me a new final tax award notice and there is nothing on there about the over payment they claimed they had paid me for 13/14

    Having the new award notice doesn't really confirm that it should/shouldn't be included, only that the adviser you spoke to doesn't think it should be and they have removed it.

    I'm not saying the adviser isn't correct, they may have been. But for my own peace of mind I would get it in writing from tax credit office.

    I understand what you are saying. But all this (changing award notice).Proves that i told them about it many times and they have deemed that it does not need to be included. so if at a later date it is said that it should of been included. then surely that would be down to them and I would not have to pay the money back.
