First exchange, next repair, finally refund?

I got engaged on Christmas Day. My fiance chose the ring as it was a surprise. He took out insurance on it, 3 weeks later a diamond had fallen out so we took it back to the store who immediately exchanged it. Great service I thought. 2 months later another diamond had dropped out of that one. Again we returned it to H. Samuel but this time they would only send it off for repair.... using the insurance. Four weeks later I've just got the ring back. Out of curiosity I looked up revews on this ring on their website. Several reviews mentioned lost diamonds within weeks. My confidence with this ring is fading. What would my rights be should another stone fall out?

Unless you got a report to prove the ring was inherently faulty then the retailer has the right which option to choose.
Just as an aside, you have no rights, your boyfriend as the purchaser has the rights.0 -
Check what they offer in terms of after sale service as many jewellers will provide a free check on the setting to ensure that the stones are secure. It is usually recommended after the first few months of wear. Make sure that it is properly declared to your home insurers for when the insurance with the seller expires, though it is unlikely to affect your premiums unless the ring cost a substantial amount. At the moment you are dependent on what the seller offers in terms of repairs/replacement should you lose another stone, as Krisdorey has already said.0

Thanks, but the stones fell out of two different rings. The online reviews have noted the same problem. It would seem that there is a design flaw somewhere but I do understand that would need expert opinion. I understand that it is my fiance's rights and not mine since he was the purchaser.0

I think you have got the SoGA a little bit confused here.
Depending on when the ring was bought a independent report may be required (6 months after purchase). If the report proves that the ring is inherently faulty, the retailer can still choose repair, refund or replace (not quite that simple) unless it causes significant inconvenience.0 -

But online reviews and commentary are purely circumstantial evidence - if you're planning to make a claim then you'd need a report to prove it.
As it stands you have no basis to force them to give you a refund.0
