Tickets paid for via Paypal... Rights?

Hi all

I ordered x4 middle tier tickets (face value £80 or £100) via a reseller for the Froch v Groves fight at Wembley. After a number of emails and a phone call - I was reassured that the tickets were allocated as ordered and secure. They advised that there had been a delay with their supplier and the tickets were unable to be posted out in time, so they were sending a rep so tickets could be collected from Wembley on the night.

My husband collected the tickets from the company's rep (who turned out to be from a distribution company - not directly from the company) and they were given x4 upper tier tickets, £30 face value. When they got to their seats, they were literally the worst seats in the house - very back row up in the gods... The ring looked like a postage stamp and the screens weren't much better.

Suffice to say my husband was not happy at all, but there wasn't a lot he could do on the night. He and his friends had travelled to London, booked hotels etc so not only are they out of pocket on the tickets but also on the extras. I ended up buying it on pay per view for them to rewatch when they got home so another £17.

This happened to some other customers, and other people's tickets were 'upgraded' so there has obviously been a balls up with whoever was handing them out. The company have tweeted saying there has been a 'huge error' and that it will be sorted today. I have contacted their office but the person I need to speak to isn't available and I am awaiting a call back. I'll be honest, I'm not holding out much hope at getting any of our money back at this stage.

The problem is that I paid for them via paypal, and as they were ordered on 10th March, it is past the 45 days to make a claim (I already put a claim in and it was immediately closed).

My question is, if the company don't do the right thing and give us at least some money back, do I have any chance in claiming it via a bank chargeback? I have a feeling I know the answer to this, but would appreciate if anyone could advise.

    The answer is No.

    You would need to pursue the seller via the small claims court, starting first with a Letter Before Action.

    Do you think there would be much point in going down that route if they don't play ball?

    Total cost of tickets was £558 less postage - should have been £320/£400 worth of face value tickets and the ones supplied worth £120 total. So out of pocket by at least £200 just on tickets, plus box office fee, x2 hotel rooms, travel). Could have bought the £30 tickets at face value from official seller but husband said there was no point booking hotels, travelling etc for those seats so paid the inflated price from this company for better seats.

    Do you think full refund is in order?

    Full refund? Probably no. But certainly a refund for the difference between what was ordered and what was received. The additional items (Sky Box Office, travel, hotels) would be difficult to justify.

    If they don't play ball straight away then a LBA usually bucks up the ideas of such companies. (You could even fill in the MCOL form [Google MCOL] and enclose it with your LBA). If you DID need to proceed to court action then you'd include the cost of bringing the claim in the value being sought (filing fee, hearing fee, reasonable expenses like postage, attending a hearing etc.)
