Ppi claim: Cap one and the fos

Hello. In July 2013, I submitted a PPI claim to Capital One on the basis that I had pre-existing medical conditions relating to a back problem and that the exemptions had never been made clear to me. I also had an Occupational Health scheme with my employer that would continue to pay my salary in the event of illness. Cap One rejected my claim and I referred the case to the Financial Ombudsman in October 2013. I received a letter from the FOS in December 2013 stating that the had upheld my case and had written to Cap One asking them to make an appropriate refund to me within 28 days. I then received another letter from the FOS saying that Cap One had appealed against their decision and that they were negotiating with them to provide a satisfactory outcome. I have since received 2 more letters from the FOS saying that they are still in contact with Cap One but if they can't reach a satisfactory outcome, my case will be referred to an Ombudsman for a final decision.
Has anyone else been in this position? Is the FOS likely to stick to it's original decision? Does anyone know how long cases like mine are taking to be resolved? Is there anything I can do to expedite things? Any advice from members would be much appreciated. Many thanks.

Yes. Quite a lot of people.Is the FOS likely to stick to it's original decision?
It depends on the adjudicator. Historically, the ombudsman didnt overrule the adjudicators much and statistically that is still the case. However, the FOS side with Cap One in most cases. So, an adjudicator decision against them is unusual.Is there anything I can do to expedite things?
