Ombudsman upholds claim, but M&S haven't paid out

Hi,

I've had the Ombudsman uphold my claim against Marks & Spencer (Allianz?) to repay my PPI claim. M&S haven't paid up, nor have they replied to recorded delivery letter chasing payment.


What can I do next?
Do they have to pay when the Ombudsman agrees?
How long can they stall for?
Do I go back to the Ombudsman?
All the correspondence from the Ombudsman regarding claiming against M&S mentioned the insurer Allianz who were covering M&S claims. Do I now need to chase them. The card PPI I'm claiming for was with M&S, so am I right to stick with chasing them and not Allainz?


Any advice or experience of what to do, or what has worked for you is welcome.

    Was it an Ombudsman or an adjudicator who found in your favour? This is important.

    If it was an Ombudsman, did you confirm to FOS that you had accepted the decision in writing?

    Why are you doing the chasing yourself? FOS should have written on your behalf to instruct the Bank to pay.

    However, it's also possible that the Bank have appealed the adjudicator's decision which means the case now goes to an actual Ombudsman. Unfortunately, this can take many more months.

    You need to contact FOS to clarify this, no point writing to the Bank...

    What are the timescales involved? Date of decision etc
  • I received the decision from the Ombudsman in March telling I had nothing further to do as within 6-8 weeks (the time taken to calculate repayment) I should receive the repayment.

    I have now written to both M&S(twice) and Allianz (once) chasing what is happening.

    Has anyone else experienced delays in M&S or Allianz playing for time and dragging their feet over repayment?

    I guess my nextstep is to write back to the Ombudsman and update them on the situation?

    Yes, you need to contact the Ombudsman-not the Bank.

    If you read my earlier post, you'll see that

    You need to contact FOS to clarify this, no point writing to the Bank..
    If the bank have appealed, this will also account for their failure to reply to your letters.
