Unknown CCJ

I recently checked our credit reports, after completing a lump sum IVA to find a mystery ccj on my OHs file. It's from 2008, around the same time we got a ccj and charging order from NRAM. We had around 6 or 7 court letters arrive, transferring to different courts and copies of the letters to my OH, after looking through the old paper work there is 1 letter with a different case number on it (this must be the one on the file) the nram loans were for similar amounts so got very confusing at the time.

We obviously knew about the charging order and agreed a payment schedule. But knew nothing about the ccj for our other nram loan, surely we would have received something in writing or arrange a payment for this ccj? It's a worry because this loan was settled in our IVA last year.

Any advice welcome :)

    So this loan was part of your IVA?

    And is the date of the CCJ before or after the start date of your IVA?

    Yes this loan was paid off in our IVA, we didn't even know that a ccj had been added against this account until after. The ccj is dated October 2008, we completed the IVA in October 2013.

    What was the start date of your IVA?

    i.e. is the CCJ dated before or after that date, and by how much?

    It was a lump sum IVA, so it was started and completed on the same day, if that makes sense. The ccj is dated way before the IVA was started and completed.

    After looking at my report, the IVA completed in Feb 2014. Still way after the ccj date.

    Ah. I see. That makes more sense.

    Well the IVA basically means that the CCJ cannot be enforced any longer.

    It still exists and will sit on your credit report until October this year, when it will disappear.

    The IVA will be on your report much longer anyway, so its pretty irrelevant in the meantime.

    Thank you. I was worried that the ccj would render the particular loan exempt from the IVA or something. It's a relief if the IVA 'over rules' it. It's still states active, does this mean anything? Thank you so much for answering and sorry for seeming dim lol

    No. Doesn't mean anything.

    Rules of the court/register mean a CCJ can only be marked as satisfied in it is "paid in full". Literally that wording.

    Which means that although it may not be enforceable any more due to the IVA, it stays open as far as the register is concerned.

    It still drops off 6 years from the judgement date, so not a huge deal.
