    Thanks coupon -mad , I'll have a good read of the newbie notes , I was all of a panic earlier , when I use the template to appeal should I use the first 3 points and add a 4th point regarding the emergency but I shouldn't own up to being the driver ? . Like you said I should state facts. Like " the driver of the car pulled over" and " the passenger was having an emergency medical " ?? ,,
    I'll have a good read and fill no forms in until I know exactly what I'm doing lol ,, thanks folks ,

    it does if you are going to complain to the landowner using the EA 2010 , as we now know its peel holdings

    What I think Redx is saying is that you should at same time as preparing appeal, send a letter to Peel holding demanding (not requesting) that they get the PCN cancelled as they have not kept to the Equality Act 2010 which gives people protection when living with a disability such as this. They should squash it immediately for fear you will try to take them to court along with the PPC.

    Yes to all of the above - panic over, you've got it now.

    And yes why not, about the complaint to Peel Holdings as well - again written from the point of view of the registered keeper being annoyed about the harassment, not saying who was driving but going into sufficient detail about the emergency medical issue of 'the passenger'.

    C-m is there a link available for a template that I can use to complain to peel holdings, do you think I should keep the letter short & sweet ,ie, dear sir /madam , as the registered keeper of vehicle *******' I am very annoyed about the harassing and threatening nature of the letter I received regarding the incident . The driver of the vehicle stopped briefly while the passenger rectified a MEDICAL EMERGENCY with his colostomy bag coming lose and leaking. The passenger is registered disabled and his blue disabled badge was clearly visible . I as registered keeper will appeal this charge and win ..I demand you cancel the PCN under the Equality Act 2010.....

    Dear xxxxxx,

    URGENT COMPLAINT: HARASSMENT OF A DISABLED PERSON BY VCS PARKING SERVICES
    I must make an extremely urgent official complaint to you and a personal plea to sort this out, please.

    The situation is that we have received out of the blue, a 'parking charge' following a visit to the International business park. However, the fact is that the car was not in fact parked at all and was merely forced to stop temporarily because the passenger .................................................... {explain without saying who was driving so no 'me/myself/I'}.

    I believe that this sort of letter, sent without consideration of the circumstances, is discrimination under the Equality Act 2010 (EA) because disabled people must not suffer any detriment or harassment as a result of something connected to their long-term debilitating medical condition. If the private parking firm, VCS, patrolled areas properly and did not merely rely on secret cameras, then any reasonable investigation by an attendant would have revealed that the passenger's blue disabled badge was on show the whole time. And the car was not parked, not left unattended and the stop was minimal and purely a medical emergency.

    You are no doubt aware that landowners of public premises/facilities are legally liable for the illegal actions of your agents at all times:

    As the registered keeper of the vehicle, I am particularly annoyed about the harassing and threatening nature of the letter I received regarding the incident and the passenger is horrified at this draconian 'ticket'. Please ensure that the company cancel it. I have of course written to VCS but have no faith in this notorious firm to resolve the matter quickly and fairly, and felt you needed to be made aware of the actions of this agent.
