                    My wife had her pocket picked and her purse stolen with her credit card etc.  the thief managed to with draw £500 cash using an ATM, the bank is now refusing to refund.  The Police aren't bothered about looking into it either.  Anyone have any tips to recover the lost money ?

            Does the fact that cash was withdrawn mean that she had her PIN written down somewhere in her purse too? I can see why the bank would consider that negligent, or are they refusing to refund for another reason?0

            Often thieves peep and see the PIN first, e.g. in a shop, then pickpocket the card.0

            Can you prove that you were no where near the ATM at the time of withdrawl?0

            Why are the bank refusing to refund? Is it because they think it was really her who made the withdrawal, someone else made the withdrawal with her consent, or do they believe the card was stolen but that she was negligent with the PIN?
 If the latter she should only be liable for the first £50, though banks' T&Cs often state she's liable for the whole lot - but the law overrides the T&Cs.
 Has she got a police report about the theft?0

 Yes, some people are real numpties when they enter their PIN, obvious single finger presses and no attempt at all to hide the PIN. I was in a queue once and saw the PIN nearly everyone ahead of me entered!Often thieves peep and see the PIN first, e.g. in a shop, then pickpocket the card.
 It's so easy to disguise the PIN entry even if you haven't got a hand free, just put your whole hand over the PIN pad with fingers on different numbers. But ideally cover with your other hand.0

 This isn't an alibi. If it were, you could give a card and a PIN to a friend to withdraw cash and then simply say that you were nowhere near and easily prove this.Thrugelmir wrote: »Can you prove that you were no where near the ATM at the time of withdrawl?
