new phone wont work

I bought a new phone from carphone ware house by credit card. After 30 days the phone packed up. I returned the phone and it was sent away for repair, when it was returned I was told it needed a soft ware update. Less that a week later it has packed up again. What can I do about it?

    Under the Sale of Goods act you are entitled to a repair, replacement or refund, but it's the retailer's choice (assuming that the fault is not caused by mistreatment)

    However, with two faults so early in the life of the phone, you may be able to argue the point of rejecting the purchase altogether.

    What outcome do you actually want?

    Then i would act quickly and tell them that due to two faults in 5 weeks, you are rejecting the phone, and wish to purchase a different one.

    Are you sure though that you have not just changed your mind about the purchase?

    Carphone Warehouse used to have a 'no lemon' guarantee which stated if you had three repairs under warranty they'd give you a brand new phone - even if they don't still have that I've always found them very helpful - they're the best of a bad bunch.

    Silly suggestion (and fraudulent). Manufacturers can tell if a phone has been wet. They got fed up with people dropping them in water and then claiming the phone was faulty, so they put a component in to detect this.
