    The Memorandum of Understanding between the BPA and the BVRLA removed the need for the hire agreement & statement of liability AFAIK, making life fairly easy for hire/lease firms to discharge liability, if they did but know it. It really only needs a letter I believe, saying the name & address of the driver. This was explained to BVRLA members in January/February in at lease one BVRLA newsletter. Once the letter giving the driver's details is received, the PPC cannot revert to the lease/hire company keeper - and if they try, the lease/hire company keeper can't suddenly bully the hirer by paying and debiting the hirer's card, because it's none of their business by then.

    However, when push comes to shove, it's probably an unfair contract term because, whatever way you look at it, a private parking charge is neither their problem nor any of their business. Especially if they are proposing to charge some ridiculous sum like £35.
