Disabled Parking

Hi I am a disabled driver who parked in a cinema and food complex in cardiff, I parked in a disabled bay knowing that the date on the badge had expired, I had however applied for my new badge , in the meantime I displayed the out of date badge thinking that if an attendant looked at the vehicle and the badge was out of date he would look at the tax disc as well, this would tell them the car was a mobility vehicle. as we came out of the cinema I could see the badge on the car and on exiting the car park spoke with the attendant who said once issued noting he could do.
So when I arrived home I phoned the local council , they told me they had not received the form back and said it may have got lost in the system or the post, and sent out another badge application.
I completed and returned the form the same day and returned the form this time by hand, in 6 days I received my new badge. I appealed before the blue badge arrived but kept the cover letter that came with the application as I did my first application.
I included both the heading letters that proved that I applied for my new badge prior to the ticket and the second header showing that I had again applied for a badge after, needless to say the appeal was turned down. I am now outside the second appeal window as it must be within 7 days, any suggestions I would be greatfull.

BB or no BB the landowner and PPC are still bound by the EA 2010 , but bear in mind a BB has no relevance if this was private land , only the EA 2010 , and the tax disc has no relevance anyway and is being phased out this october so never will have any relevance
is this a council ticket or a private parking charge ? if its private who issued it ?0 -
Theticket is from a private company a member of B.P.A
Another point the ticket says the car was black it is infact metalic brown0 -
the colour is irrelevant and wont be considered in any appeal
as its a private PPC you need to appeal it by reading the NEWBIES sticky thread at the top of this forum , same as anybody else
the contravention is not displaying a valid permit (the BB) which is how they interpret the rules on disabled bays , even though its not within the EA 2010 requirements
so appeal the ticket in the usual manner as in the NEWBIES thread
and you can also complain to the landowner and quote the EA 2010 due to the fact you are protected under the act and the BB is not relevant when parking on private land
forget the car colour , forget the tax disc too , appeal on legal points , not mitigation0 -

Hi Steve,the part I highlighted is relevant when I worked with the Police we used to see people displaying out of date badges and when they got a ticket they used to send in the badge which had not expired,hope you are successful my friend.
YBplease do not pick on me for my grammar,I left school at fifteen and worked in the building trade for 55years ,

Yep but that's only the case with real PCNs. This isn't one, it's a fake PCN from a private firm and they make it up as they go along and have an agenda of pure moneygrabbing. Mitigating circumstances LOSE at POPLA re private (fake) PCNs - so we don't use that argument. The OP just needs to tell these scumbags that he has appealed and so their only option is a POPLA code or cancellation.I am now outside the second appeal window as it must be within 7 days.PRIVATE 'PCN'? Hi eveyone just wanted to let you know that I wrote a letter to the land management company savills, they responed very prompley to inform me the notice had been cancelled and even apollogised for the the bad experience.
write to the landowners as soon as you can I just explained it as it was and was completely honest. thanks everyone for your help. if it was'nt for the forum I would not have known to write to the land owners.
