PE Claim Struck Out in Brentford Court Today

3QT62386, PE v Mr Arora.
This case originally started in December, when DJ Jenkins adjourned the case, to allow PE to substitute the landowner as claimant if they wished, and to bring forward any similar cases for hearing at the same time.
Today's hearing was notified by the Court as being for 'handing down of Judgment', which was a bit puzzling as neither side had yet had an opportunity to state their case. The LPC rep who turned up had no paperwork, and no knowledge of the details, his instructions were simply to make a note of the Judgment.
DJ Jenkins apologised for the Court letter, saying that the handing down only applied to the other case being heard today. He went through the chronology of our case, saying that PE had failed to comply with his original order, and had subsequently failed to submit a proper application to reinstate the case, instead of which they had just sent a letter with VCS v HMRC attached.
The claim was therefore struck out, and the maximum £90 awarded to the defendant.
A good result post-Cambridge.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Yes it's a good result, but we need some more now with parking eye using it as part of their defence. I'm sure district judges will be treating it like all other no claims, and that the decisions are non binding on other courts. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

That was a great result and total waste of time & money for ParkingEye spy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
