These circumstances are not strange or specific.
Basically you failed to comply with the parking company's made up rules and they have issued you with an invoice for not complying. This is the same for all claims of this nature, whether that's overstaying, not parking in a bay, not paying for a ticket, or not entering your registration number into a machine.
The steps are the same:
1) Appeal to the parking company and obtain a POPLA/IAS code; then
2) Appeal to POPLA/the IAS using the legal arguments contained in the templates.
I have made the word 'legal' bold for a reason, as these are what the arguments must be. They are not interested in what happened on the day. All they are worried about is whether the PCN was issued legally and to a lesser extent in compliance with the relevant code of practice.0 -

Like other Sportspace users, I have looked at the example Popla appeal to Civil Enforcement Ltd but a lot of the points don't stack up ...
I get the generic points to raise in order to win regarding keeper liability, etc, but am confused on how to work the bit about the alleged breach.
Essentially we are being "invoiced" for failing to input numberplates or inputting them incorrectly (in my case).
Can we ask them for evidence of not having inputted numberplates?
What do we say about signage?
What do we say about section 9?

Isn't that pretty much all in the example I gave in post #10, the second link which already has the paragraph you need about POFA Schedule 4 paragraph 9 non-compliance of the NTK? IMHO the whole example I linked is practically useable - you only need to amend a bit about the signage as it won't be the same exactly.PRIVATE 'PCN'? Furthermore, complain vociferously to your councillor. "Sportspace" is in fact Dacorum Sports Trust, but the site is still owned by Dacorum Borough Council, and Dacorum Sports Trust relies on a grant from DBC to operate, so although Dacorum Sports Trust leases the site from DBC, DBC still has a lot of clout with them.
It's also pertinent that Dacorum Sports Trust is a charity, so you should complain directly to them that by engaging CEL to levy £100 fake fines they are causing serious harm to the the people they are supposed to help, i.e. users of the facility who inadvertently fall foul of CEL's arbitrary "rules". If they give you the brush-off, escalate the complaint to the Charity Commission.Je suis Charlie.0 -
I just wanted to update you to say that after complaining vociferously to Sportspace, they have rescinded my ticket on my behalf. Customer complaints manager admitted that a great deal of time is being taken up by staff having to cancel tickets issued to bona fide customers. DOH! Why employ these cowboys in the first place, then?
Message to all BONE FIDE Sportspace customers who have been "fined". Go to Sportspace and stamp your feet! It not only works but might also serve as a reminder that treating customers with contempt will only end up costing them time and money in the end. Thank you to everyone for their help on this forum. I know you all volunteer your time to give free advice and it is very much appreciated.0 -

All the more reason for your councillor and the Charity Commissioners to know that the council's grant and the charity's funds are being wasted in this way over what CEL doubtless sold as a "free" service.Je suis Charlie.0

Hi,
I am expat living in NZ. Before Christmas I was visiting the UK and was a bona fide user of this Sports centre (for less than an hour) but was unaware of any car parking requirements as I dashed in and out and it was dark so saw no signs in the car park.
To complicate things I had a rental car; they have somehow found an old Uk address and a PCN from Civil Enforcement has been forwarded to me.
Have tried calling Sportspace but was told there is nothing we can do here's Civil Enforcements email address.
As I don't live in the Uk can anyone advise the best course of action?
I've had a read around the forums but the advice is for people living in Englad/Wales/Scotland.

if you are not coming back, you can ignore it, they cannot transfer a case to new zealand , lol
sportspace are LYING, as landowner thay can cancel the ticket
you can send CEL the template letter and then use popla if you wanted to , once you have a code

I don't understand this. How does "an old UK Address" enter into the picture? CEL will have written to the hire company, who are presumably in possession of your current address in NZ.
It's important to clarify this. The only way this could end up costing you is if the hire company pays it and then charges you, and/or the hire company charges you a hefty "admin" fee for passing on your details (which could've happened already).
So we need to understand exactly what the hire company's involvement is. But please start your own thread: them's the rules here, one case, one thread.Je suis Charlie.0
