PPI mbna

Hi

Ive been battling to get PPI returned via FOS. They didn't feel I was mis sold. Is it worth me now going via a PPI company?

Surely I have nothing to lose..

    No.

    If the FOS have decided against your complaint, then that's it. Making the same complaint again via a PPI company isn't going to produce a different result. The bank (whatever) will simply dismiss your second complaint out of hand, and the PPI company will lose interest the second it finds out the FOS have already decided against you.

    A PPI company wont do anything different that you have done already. If FOS have rejected your complaint then its probably time to move on and accept it probably wasnt mis-sold.

    Yes you have I'm afraid. If you employ a claims company then, when they discover that you have already complained, they will charge you an administration fee for wasting their time.

    You only get one bite of the cherry with FOS, so you can't keep on complaining after you've been finally rejected.
    Your only other alternative is to take the Bank to court, but you risk losing and being charged costs. You'd also need both valid and verifiable documentary proof you were mis-sold to stand any chance at all in court.

    As others have said, might be wise to accept that you were not mis-sold and so move on from this.

    No. A claims company uses the same method you do. All they do it pop your forms in the post for you instead of you licking the stamp.

    The FOS is the independent arbiter when you disagree with the company. Have you considered that your complaint is weak or invalid and that is why you are having problems?

    thanks for the replies.

    I went for:
    My work benefits were so great that I didn't need pip
    I felt pressured to take it
    I had a pre existing medical condition - knee reconstruction - that wasn't asked about.

    None of this worked

    How great? Many people over estimate employer benefits. It can be a valid reason on some short term debts if employer pays 12 months but less than that it is less effective. For mortgages and long term debts, it is not generally a suitable reason and where the plan pays out in addition to employer benefits, it is not a good reason.

    unprovable allegation and you wouldnt expect that to win. If you complained just after it happened then you would be credible. But the longer time goes on, that credibility is lost.
    I had a pre existing medical condition - knee reconstruction - that wasn't asked about.

    Not a sufficient medical condition that would cause too many restrictions on the policy.

    To be honest, none of your reasons are strong and you can see why you are not getting success.

    It was probably a non advised sale anyway so they dont check if its suitable, thats up to you to decide if your employer benefits are sufficient.

    They wouldn't necessary ask you about pre-existing conditions if they weren't providing you with advice. As long as they give you clear information that it was excluded. Is it also something that may reoccur and keep you off work in the future? probably not, so if they had pointed it out I doubt it would have affected your decision to take the policy.

    I know its not what you want to hear but I can see why your complaint hasn't been successful.
