Luton Airport Parking Fine

Please be gentle.

I was picking up the other half from Luton airport and have subsequently received a fine for stopping on the road. I allowed a bus to pull out and as I was doing this the other half jumped in the passenger seat.

I have now received a penalty notice from the operator of the road. The letter was sent to the registered keeper 19 days after the so called "offence"! They have then forwarded this onto me 14 days after sending to the registered keeper. Is there any way I can get out of paying this fine? Any help would be much appreciated.

    I had been reading the previous threads and stickies and there was advise not to hijack an existing thread or follow potentially out of date information. This is why I have started a new thread. My apologies if this is wrong.

    also read the paperwork again , and then use the correct terms to avoid confusion

    its neither a fine nor a penalty , its an invpice and will say parking charge notice or similar, the words FINE and PENALTY will not be on that paperwork at all as that would be illegal

    read the NEWBIES thread and use search words to find dozens of similar threads, then just follow the advice given

    Nope don't apologise, it was right for you if you wanted to start a new thread straight away... but maybe not needed yet as the NEWBIES thread and searching the forum should set you on the right path. Then if you want more help at POPLA stage you can add to your thread here then by showing us your POPLA appeal draft (which you can copy from other Luton Airport threads!).

    Can I send the below, even though I am not the registered keeper as its a lease vehicle?
    Dear Sir/Madam,

    I am writing to you as the registered keeper of the vehicle in relation to a parking charge notice (PCN no. XXXXXXXXXX) received on XX/XX/2013. I am asking you to cancel this charge immediately for the following reasons.


    1) The supposed signs/warnings were not adequate. The signage is not adequate to form a contract between driver and operator. The key wording is too small and too detailed to read from a moving vehicle. The only way to read the signs is to stop and park, thus contravening the instructions.

    2) No contract was knowingly entered. Forming a contract with ill informed customer is in breach of The Consumer Protection from Unfair Trading Regulations 2008

    3) The charge is unjustified. If the ticket is not cancelled I will demand proof of how an extortionate sum could possibly be calculated as a loss to either the landowner or APCOA.

    4) No legal authority to issue a PCN. The operator is not authorised by the landowner to issue charges.

    5) POFA 2012 does not apply so registered keeper is not liable.

    One of the points for my appeal is based on the assertion that your parking charge does not represent a genuine pre-estimate of loss to yourself or the landowner. In every case where a motorist has raised this issue, POPLA have accepted the appeal. You are therefore fully aware that there is no prospect of your charge being upheld. If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you and my time at the court rate of £18 per hour. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    If you do not cancel this charge I would like you to send me a POPLA code as I will be taking this to them.

    Don't say "registered keeper", merely say "keeper". This is the term used in the Protection of Freedoms Act, and it means the de facto keeper (i.e. you), not the registered keeper.

    This handy little get-out enables you to deflect APCOA's attention from the lease company (which is desirable, because lease companies have a nasty habit of paying these things and then chasing the lessor for the money plus a hefty "admin" fee) whilst not naming the driver.

    I would expand point 5:

    "POFA 2012 does not apply because no part of Luton Airport is 'relevant land' within the meaning of the Act, therefore the keeper cannot be held liable."
