How long is sanction for JSA?

A friend of mine has been struggling with her job due to a hip problem. Work were aware of it and had made concessions for her.

however she has stupidly had a bit of a do with someone at work and basically walked out rather than waiting till they finished her for being unable to do the job.

She is now in a position were she cant claim JSA because she walked. Does anyone know how long she needs to wait before being able to claim if she does not manage to get another job quickly.

She now has no income whatsoever. She does live with someone but he is not her partner in the sense that they are a couple. He is struggling to afford his outgoings and has several debts and she moved in with him to help out financially and of course now that's gone haywire and he cant afford (neither does he want) to support her.

There are sanctions of varying lengths depending on offence, with the shortest being four weeks.

But I think (and might be wrong) that if someone leaves a job without good reason and tries to claim JSA the sanction is for six months.

I assume your friend has explained her situation to the DWP and a Decision Maker has still decided to sanction the claim?

I recommend that she still claim and sign on (she can still sign on, she just won't receive any payments of JSA for the sanction period).

She may be able to get hardship payments?

If she is not part of a couple she may be able to claim CTB and LHA as a lodger?

How much was she paying him previously? Can she evidence this from bank payments etc?

Any job, of whatever length resets the sanction, including as I understand it even jobs expected to last one day.
It is very likely that the person she lives with will be seen as her partner, and may be expected to support her.

If whoever she lives with is not her partner, she needs to make that clear, and she might be subject to them querying it.

Assuming they accept she is single, she should be able to claim Hardship Payments, after two weeks.

You can tell a lot about a woman by her hands..........for instance, if they are placed around your throat, she's probably slightly upset. ;)

Nowhere in the first post says that she has actually been sanctioned yet.

Assuming it is pre-claim, then it's not automatic in any sense that she'd be sanctioned. It depends largely on how well she puts her case. If she found it medically very difficult to work that might be sufficient ground for her to leave the job.

If she has been sanctioned it may be worth getting someone at the citizens advice bureau or similar to request a mandatory reconsideration.

There may be other help that she is eligable. If she can get a temporary job then that would be good too...
