Excel Parking PCN POPLA Appeal Query

Thanks for all the useful help here. I am trying to appeal a PCN which has just gone to POPLA. I bought and displayed a parking ticket at Broomhill, Sheffield which I still have. I disputed it, unfortunately without all the legal jargon here as I thought the fact I could produce the ticket would be the end of the matter! :( Now I have entered the surreal world of PCNs, VRMs and verification codes!!

Two questions really if someone has time?
  • Keeper Liability - if I was the driver and my husband's the keeper and they can only pursue the keeper, is there an advantage in declining to name the driver and saying they have to produce evidence?
  • I didn't realise I had to put the car registration details in the machine when I purchase the ticket, therefore the ticket I purchased had the code S rather than the car registration number. Their letter says 'it is important that you enter the full and accurate registration when purchasing a ticket'. However they are stating their signage states that; 'Parking charge notices will be issued for failure to purchase and/or clearly display a valid ticket/permit'. I purchased, paid and displayed but I imagine this isn't a valid argument. Can I complain that the machine allowed me to purchase a ticket without putting in the registration details and therefore formed a contract with me?
Many thanks for any advice before I draft my letter to POPLA and good luck to everyone fighting these outrageous companies.

    they can actually pursue the driver , if they know who it was , this has always been the case

    pofa 2012 can make the keeper liable if they do not know the driver , so generally the RK is the one that appeals and does not name the driver at this stage (there is no legal requirement to name the driver)

    so your question seems ambiguous , as I assume the RK got the pcn and so appealed it and got a popla code , in which case the driver isnt relevant to any of this at the moment

    you can complain as much as you like if you wished to , but popla doesnt accept mitigation (it says so on their website) , they only consider legal arguments like not a gpeol , no contract , bad signage , anpr errors etc

    Read the NEWBIES THREAD and look at post 3 in particular.
    There are lots of examples of appeal templates to use.
    As you appear to have already appealed and identified yourself as the driver, You can't now pass the ticket over to the keeper.
    You can always add a final point to appeal if you wish about machine, but it won't win you the case. You will win on the legal arguments in the templates.

    You just need to email POPLA with the additional evidence you require them to add to your appeal. Such as no GPEOL etc. - basically add the sort of stuff you will see in a POPLA appeal linked under 'How to win at POPLA' in post #3 of the Newbies sticky thread.

    As you've no doubt seen, you'd definitely lose at POPLA if you rely on the mitigation about 'what happened'. Neither of your questions help at all. You are focussing on the wrong things, both aspects which can't win at POPLA. Have look at what does!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
