Hello all.
Well, I followed all the on site instructions to claim back my charges and basically here's what has happened:
In May I wrote them the second letter, stating that if they didn't respond in 14 days I would issue proceedings through small claims etc etc.
They didn't respond within 14 days, and so I filed the claim. The issue date was 5th June 2007.
Then on 11th June, I recieved a letter (though it was dated 29th May) - offering me the amount in full as a gesture of 'goodwill' and that I should send back a signed form and they would transfer the money into my account. Which I did and so I got my charges back.
However, I have now recieved a letter from their solicitors saying they have entered a defence and asking me to respond to a number of legal points.
I have written a draft letter explaining that I will not be taking the case any further since Natwest kindly refunded my charges. Is this the right thing to do? What will happen if it goes to court? (or when it goes to court I guess..)
Advice appreciated!!

LOL was it MCOL? email them - address on their site and tell them that you've settled the claim.
Also write to the solicitor saying you have received the fund for the charges but if they could forward you the court costs you will close stop proceedings
Err on 2nd thoughts, write to the solicitors first then when they pay out your court fees stop the court proceedings
oh yeah tell them if they don't pay you'll add the 8% interest on!

Hehe, well the thing is even though it's cost me the court fees I'm happy that they've refunded me. Though, how do I stop court proceedings? On the moneyclaim site it just says it has been transferred to an actual court as they've entered a defence.0

You write to the court and if you don't know which one it is, ring MCOL. Don't just let a settled court claim go on. The solicitors really are silly though, all they would have had to do is base their defence on the fact that you have got a pay-out already. Left hand, right hand...Reclaimed thanks to this site:
