New Job - Notice/Holiday, what is legal?

Hi all,
Does anyone know about holiday and when you give in your notice etc..?
I have got a new job and i am going to hand my notice in tomorrow. I would like to use some of my holiday as notice but i'm not sure how to negotiate this as its such a busy time and we are so understaffed.
Does anyone know the legalities? Is it up to the company to decide if i can use some of my holiday or not? And what if they say no? I have just moved house ya see and could really do with the week as a transitional period between jobs!

you need to check your contract and/or employment handbook (if there is one) to see what the rules are for your particular company.I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0

According to the Working Time Regulations, for holidays you need to give twice as much notice as the length of time you want as a holiday. So, if you want a week's holiday, you should give at least two weeks notice.
The employer can say "no" and if your firm is really under-staffed at that time it seems likely they would - as long as they feel they could rely on your doing a decent job if you did work.0 -
If they say you can't take the leave as leave, they'll be obliged to pay you for it. So if you're giving a month's notice, and your leave year runs from January, and you haven't yet taken any leave, and your leave entitlement is 20 days PLUS bank holidays, then you'll be entitled to 7.5/12s of 20 days paid leave.Signature removed for peace of mind0
