Parking in Disabled space in Lidl

Options
Hi folks,
Sorry if this kinda question has been asked before, but I can't find any thread!!
My mother-in-law received a ticket whilst shopping at Lidl the other day. She parked in the disabled bay (She does have a blue badge), but forgot to put her badge up. :-(
When she came out, she had a ticket on her screen. The warden person was there, so she went to him and showed him her badge, proving she was entitled to park there. He said the ticket stands and she has to pay. :-/
She has a motability car, so if he had looked at the tax disc, he would have seen it was a disabled persons car. Would this make any difference if she appealed?
What do people suggest she does? She totally admits it's her fault for forgetting to display her badge, but even after showing the warden, he wouldn't back down....
What do/can we do?
Thanks for any help!

Is the car registered to your mums home address? If so then wait for the notice to arrive through the post.

In the meantime have a read of the Newbies sticky thread as it explains exactly what process needs to be followed, so it'll give you some time to get your head around it.

The blue badge stuff isn't particularly important as blue badges are for public roads etc only. The Equality Act applies to private car parks. There is again a section on this in the Newbies thread.

the BB isnt relevant on private land , but the EA 2010 is , so that is the only grounds she can appeal on as a disabled person (in the context of her disability - she can appeal on other legal grounds however , like the rest of us)

get her to check the blue book she got with the badge , its only relevant on public roads etc

as for the tax disc , thats not considered valid even on a road , never mind a private car park , and they are being phased out this october so in future you wont even have one to display

lets assume though that the tax disc wasnt being displayed and she was on a public road , the contravention is not displaying the disc, which is not the same as not owning a valid disc

so the contravention here is not displaying a valid "permit" (the BB) on private land and so breaking the rules of the PPC (so not the fact she doesnt own one)

so all you do is read the newbies thread , send in the template letter same as anyone else , BUT add a paragraph about the EA 2010 and copy (scan) the BB and present it in mitigation

this may still fail and so you appeal to popla on appeal points (popla dont do mitigation nor do they allow for a BB or the EA 2010 either)

there are dozens of threads about this , so clearly your search words were not good enough as I have replied on many threads in this manner

some people are led to believe that the BB makes them fireproof anywhere , at any time , it doesnt , especially not on private land

so the lidl disabled space is provided by lidl under the EA 2010 and is for anyone who is a protected person to use, not just somebody with a BB

there are members on here like trubster who park in places like this , like at Meadowhall, do not display a BB (they dont have one) and get tickets which are subsequently cancelled due to threatening the landowner with the EA 2010 which is the actual law covering the space. the fact that the landowner or parking company dont issue permits or have a facility to add the reg to a whitelist is what contributes to these mistakes, not the vehicle owner who is only going about their lawful business

Also, go back to the store and complain to the manager.

Definitely. I would do that as a top priority, but ask for the manager and tell him the whole tale.
