Barclays - am I being accused of fraud?!

    It's worth saying that you do have to be prepared to get accused of fraud or something similar:
    We may end this agreement immediately
    (and stop providing services and close your
    account) if we reasonably believe you have
    seriously or persistently broken any terms of
    the agreement or we have reasonable grounds
    for thinking that you have done any of the
    following things, which you must not do:
    • you put us in a position where we might
    break a law, regulation, code or other duty
    that applies to us if we maintain
    your account
    • you give us any false information at any time
    • you commit (or attempt) fraud against us
    or someone else
    • you use (or allow someone else to use)
    your account illegally or for criminal activity
    (including receiving proceeds of crime into
    your account)
    • you inappropriately let someone else use
    your account
    What's normally bad in such cases, is that they don't think that their 'reasonablerolleyes.gif beliefs' need any real proofs.

    They have obviously broken their T&C.
    If they made a mistake, that they admitted, they can close the account by giving you 2-month's notice, not by giving you runaround.

    There is no point in forcing them to let you keeping the account, but IMO it's really worth complaining on principle and taking the case to the [STRIKE]FSA[/STRIKE] FOS if they don't offer a compensation that satisfies you.

    I wouldn't bother with the FSA as

    1. They no longer exist
    2. They (the FCA) won't deal with customer specific issues such as this

    You could try the FOS however, but as with credit scoring, banks do not need to tell you which part of any criteria, private or public, that may result in you failing to meet their requirements. Therefore I doubt the FOS would uphold any complaint in this regard (and the waiting time for FOS is currently around 18-24 months due to the PPI bandwagon)

    You can easily get a loan or credit card and never bother to make a repayment. People do it all the time.

    Correct, but the complaint is about closing the account already opened, not about refusal to open a new account.

    The point was that you can't escape without facing the consequences. The debs with haunt you for many years to come. You have to cover your tracks really well to avoid this.

    The FOS would also not uphold because their published decisions never go in favour of the (ex?)customer. They have quite clearly stated that a bank is not required to do business with anyone and may end its relationship with a customer as it sees fit as an exercise of its legitimate commercial judgment.

    FOS would also be privy to information said customer cannot see, including any reasons why the relationship was exited.
