child tax credit overpayment

I received 2 letters at the weekend.
1 letter asking to pay back an overpayment for tax credit period ending 05.04.12 and the other letter for over payment for period ending 05.04.11.


The letter says we have till 28.06.14 to pay the money.


I don't see how they can do this.


We have not been getting any tax credits for the last 2 years because of the over payment.


But I don't see how the fault of the over payment is with us. Every year we fill in the forms or ring and give them the exact information on our P60's.


I am sick with worry and have tried ringing the HM revenue & Customs after giving the information on the recordings they say the department is busy and to ring back later.


It also says on the letter
" You have 3 months from the date you received your award notice to tell us if you think an HM Revenue & Customs error caused this overpayment"


Is this letter I have just received the award notice because if it isn't I have not received one.

    The award notice regarding your overpayment will have been sent out in the year relating to the overpayment. So 10/11 it would have been sent out. They will also have sent one out at the end of that year during the renewals process. Best bet is to ring them of an evening (they are open til 8pm) and speak to an advisor who may be able to shed some light on the overpayment

  • Hi all, I have had a brief read through some of your posts on this matter, but I am struggling to find the advice I am after.


    In 2008 Tax credits sent me letters stating I was over £8,000ish in overpayment, I received a second one saying the same for 2007. Totalling £16 grand. I appealed, I rang, I wrote letters I sent emails, But not given any answers. I was sure I hadn't even received this amount in benefit help to begin with!


    I was contacted again in 2010 and I appealed again, as it seemed they had ignored previous correspondence. A lady adviser stated it was to do with child care. I told her I had all my receipts and invoices from all the child care used and declared for my claim. She advised I appeal. (AGAIN)


    I appealed for a third time, stating I would be happy to appear at a tribunal or suchlike with all my evidence, and let them explain to me why and how I could have accumulated such a large debt, especially as I was a single mum with two children on a part time income and paying full rent & c tax.
    I was scraping by, Having to take out provident loans to help with my outgoings as I wasn't receiving enough to begin with in my opinion.


    Still Nothing.


    I heard nothing for 4 years and this year I have received a demand from a debt agency. I contacted them AND HMRC in three different departments again, sending letters, explanations (repeating myself like a parrot) and all I got this morning was a further letter of demand from the debt agency saying I hadn't contacted them when I have the proof that I have,


    I feel victimised. I know ive been honest with my claim.


    I have an appointment now with CAB to discuss. But im at my wits end, Im already a sufferer of post traumatic stress disorder and under therapy and on meds, this is not helping me at all,


    Any advice would be appreciated. I just want SOMEONE to listen and explain and help fight this. Thankyou.
