I signed up to this forum because I need some help and didn't know where else I could to turn.

I'm dealing with some parking tickets addressed to my mum because she is not well enough to do it herself.

The car they relate to was sold in January but the parking tickets were issued shortly after. We have since received confirmation from the DVLA that their records had been updated with the new owner's details. We presume that the lag in the DVLA updating their records has resulted in the ticket's being issued to my mum instead of the new owner.

There are two tickets relating to PCNs for parking, issued by two different London Boroughs. They have both progressed to stages which make me fear I will have difficulty in challenging them.

The first says a "Charge Certificate" has been issued as no representations had been made within 28 days of the serving of a notice.

For the second, my mum has received a TE3 Form stating that na order to recover a penalty charge has been made against her at Northampton County Court. It says she can either pay or file a statement, but the grounds for filing a statement are very narrow and don't cover the fact that she didn't own the car at the time.

Can anyone suggest how I can challenge these tickets on the grounds that she did not own the car at the time, given that the letters they have sent state "It is now too late to appeal against this penalty charge"?

Would I be better engaging with the Court or the Council who issued it or both? How best to contact them when they specify that they "no longer have a statutory responsibility to respond to any correspondence."

Any advice or any words of encouragement from someone who has been in this position would be much appreciated. I can provide more details if necessary.

    I assume these are Council issued tickets?

    If so, then I would suggest you head over to the PePiPoo forum, as they have more experience in dealing with these types of Penalty Notices. You will need to upload copies of the correspondence you have received (front and back - obscuring any personal information).
