After receiving a ticket for an overstay on a retail park (free but max 3 hours, I stayed 3hrs 44mins) I was one of the many that was just going to pay until a colleague advised me to check out MSE.

I read the newbie thread and felt 'empowered' to fight my ticket!

I decided to start with a store onsite, I had shopped at M&S that day and spent the rest of the time at Costa, I wasn't aware of the max stay even though I go often and there are warning signs. I went to M&S and asked to speak with the store manager, I politely asked him to speak with Parking Eye and cancel my ticket. I didn't threaten or complain, I explained it was a genuine mistake and that I was a regular customer and would appreciate his help.

Received a call this morning from them and was informed they had cancelled it for me.

A huge thank you to the contributing members on the forum and of course M&S!

Well done for reading the advice and taking the initiative without having to post and ask what is best to do.

Well done. But be sure to get something in writing - it isn't cancelled until you have it in writing, preferably from Parking Eye themselves.

I did ask M&S to confirm in writing but they said that wasn't their usual practice, they said they have done it before and had no follow up problems from parking eye. I said if I received further communication from parking eye I would take it into the store. I would have preferred confirmation in writing so may pop in to "thank" store manager and ask for written confirmation.

    Well done bubble!

Why not email the M&S manager thanking him for arranging cancellation of the charges and just ask if he could reply to your email with confirmation of his understanding that this is now cancelled.

It means he won't have to go to a great deal of trouble in typing, printing and posting a letter, and given you have thanked/praised him for his efforts in helping you, he may not think twice about a quick, one-line reply.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
