Just wondering if they will use what we write here to their advantage? Can they change their response to popla?

Don't see how they can - after all, no matter what is said on here, it's still a fact that they can't prove GPEOL isnt it...

what do they say about the forum, at least..?

It is blatantly clear that xxxxxxxxxfirst appeal is copied from the internet. Rather than co- operating with LCP and submitting a case specific appeal to be considered, he has opted to submit a generic appeal in order to protract the matter further. Ultimately, this has cost LCP more than it would in order to consider a straightforward appeal. We are certain POPLA has received numerous of these appeals and trust you will thoroughly consider all the facts before reaching a decision.

As we are all too well aware. That's why we continue to submit them, because not one has yet failed in defeating a PPC at POPLA.

A second, amended appeal was sent to POPLA.
POPLA advised me that they had told LCP that this was the one they would be considering and the first should be disregarded. Therefore they have not addressed all the new points raised.

    Their comment...
Xxxxxx is the ‘additional information from the appellant’ which POPLA sent to LCP on 13 June 2014. On reading the contents, it is clear xxxxxxxxxx has just repeated the contents of his appeal to POPLA and therefore all points raised have been responded to.

The fact that they have not addressed all the new points! Don't make this harder than it is!

So you think POPLA will see through this if it's pointed out to them? LCP's breakdown of their expenses do not add up to £50 let alone £100!!!
I'm trying hard to get this right but am not as experienced as all of you and that's why I'm here.
    I do appreciate your advice!

Don't get deflected from the real appeal points, stick to the 'tried and tested':

    1. No genuine pre-estimate of loss (GPEOL)
    2. Signage
    3. No Contract with landowner to pursue charges in their own name at court
    4. No proprietary interest in the land
    5. Unlawful Penalty Charge
    6. ANPR Accuracy (if appropriate)

    This is their response

Contrary to Xxxxxx comment to POPLA that (quote/unquote): “Leasehold Agreement not yet seen”, a copy of LCP’s Title Register (Exhibit 4) was supplied with our 6 June 2014 email reply (Exhibit 3). There is no profit sharing agreement between LCP and the Landlord. We lease and operate the car park outright and retain the proceeds. The Landlord only receives rent.
