    2. Our signage is clear and prominently displayed throughout and at the entrances to the Car Park however for your edification, please find attached:

    i. A picture of our ANPR sign which is situated at BOTH entrances to Harlesden Plaza car park, clearly stating the car park is private property, and that a PCN will be issued for not having paid and registered your vehicles registration at the payment machine (point 1). The 24 hour Pay & Display tariff boards, of which there are 3 in the car park also states a PCN will be issued for non-payment in lieu of parking time (point 3).








    ii. Pictures of the entrance to the car park from Manor Park Road, clearly showing the BPA endorsed Car Park entrance signs, our ANPR camera signs, the Tariff boards and payment machines.

    A template copied from the internet and submitted as your appeal is blatant obfuscation. Kindly re-submit a proper appeal for LCP to consider in full. Once received, LCP will notify you as to the progress in accordance with the AOS Code of Practice.

    Please note that if we reject your specific appeal, you will be provided with a POPLA form and reference number. If you opt for independent arbitration, and should POPLA's decision not go in your favour, you will forgo the opportunity to pay the discounted amount of £50.     Dear LCP

    The registered keeper has appealed the invoice sent, the fact you are refusing to consider an appeal is a direct breach of the BPA Code of Practice and with the kadoe contract with the dvla. Complaints have been made to both in light of your behaviour in this matter.

    The DVLA has already have informed your company through the BPA this warning:

    “the following practices may be considered as Code breaches and must not be continued:
    • Asking the motorist to enter into additional correspondence to obtain a POPLA code
    • Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
    • Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
    • Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “

    Now I give you a final opportunity for your company to abide by the Code of Practice you signed up for.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

    3. As identified in the Notice to Keeper, LCP Parking Services Ltd is the creditor. Please see the attached copy of an excerpt from HM Land Registry with the Title Absolute showing LCP Parking Services Ltd as Title Holder for the Car Park. LCP lease and operate the car park and therefore are entitled to form contracts with Drivers in our capacity as Principal and we are therefore entitled to sue for charges and retain any proceeds .

    The charge is issued in respect of recovering our costs that have arisen directly from this breach by the driver of the vehicle. If there was no breach then LCP would not have incurred these costs. The act of the vehicle remaining in the car park for 15 minutes without making the requisite payment is deemed acceptance of the site terms and conditions or, inter alia, the offer.

    The dvla and bpa have in the past have forced parking companies to comply and send out popla codes. Have you made complaints to the retailer and landowner over this ? If not do so now, say you've appealed but this company is refusing your legal right to use popla the independent appeals service.
