Sky Buy & Keep

Last week I received a DVD through the post from Sky at a charge of £13.99, due to something called Buy & Keep where you get to watch the film then they send you a DVD. The problem is, when partner ordered it, he didn't realise this was the case and just presumed it would be charged at the standard pay per view rate, usually around £3.99ish. I emailed Sky to return the DVD for a refund (its still in the wrapper), and they told me no. I read the terms and conditions in that came with the DVD in the post and it says no refunds, but, surely this would be covered by the distance selling regulations?? Can anybody offer any advice please??

    What I would say if I was a Sky rep:
    "you will have ordered the item by selecting the 'buy and keep' menu"
    "The price is clearly displayed in the description"
    "You have to press 'select' when the price is displayed and asks you to agree to purchase"

    I am unsure if this would be covered by the distance selling regulation as what you are actually agreeing to is a permanent virtual copy (which you now own and have used) - the DVD is sent as an extra. For me it is as if you have signed-up to a mobile-phone deal and have decided you want to get-out-of-it because you don't want the free gift.

    I think only a test-case through the small claims court would give you a definitive answer, but would you really want to go up-against Sky's lawyers?

    As said above - it is quite clear when you try to order the film that the price you pay is much higher than a standard Sky Store purchase and also what the price includes e.g P&P.

    Would put it down to an experience that your husband will pay more attention to what he is ordering and any changes that may come up on the screen. Maybe try and sell the dvd on amazon or something at a cheaper price?
