Dispute with property developer over new-build appartment

Only loosely money-saving related (sorry!), but we're worried this is devaluing our new home...

My girlfriend and I bought a new-build flat a year ago, but the developer (a large nationally-recognised name) left site with a lot of things unfinished (mainly in the common areas) and we and many of our neighbours are having serious difficulties getting them to come back and finish it. We've been talking to them regularly and they've even acknowledged in e-mails much of what needs to be done. However, we are still without progress on all but the most trivial items. Also, I'm not an expert, but my reading of the building's planning consent seems to suggest that a number of these things should have been complete before the building was occupied.

We're now at our wit's end and I just don't have any more time left to make phone calls and write e-mails. Would approaching a lawyer help? Is it worth going to the NHBC who provide a warranty for 10 years?

Recommendations for a good lawyer (by PM if you prefer) would be welcome too as appropriate - the one handling the purchase was very slack so wouldn't go back...

    With a new-build apartment presumably you have a management company that you pay management fees to. Have you contacted them about the unfinished work?

    They will be responsible for the common parts and if they are not finished they can't reasonably take over the management (repairs, cleaning etc.)
  • That's exactly part of the problem... We have a management company but they've not taken over management of unfinished areas. We are getting a discount on our management fee, but obviously would prefer the place was finished.

    In some other cases where things are under the remit of the management company they need to be referred to the developer as warranty issues (such as broken electric gates or a lift) and these things are also outstanding.

    Unusually, we have quite a good relationship with our management company and they're just as frustrated as we are.
