Court summons council tax

Can I still include my council tax debt in a DRO if I have had a court summons just before my DRP application went through?

    You should be able to include it as long as it doesn't push you over the liabilities threshold, and maybe even this years bill as well, but you will need to speak to your intermediary first as it cannot go in after the submission.

    Thanks and do I still go to the court hearing and then explain it will be included in my DRO. I am well under £15K.

    If your DRO has yet to be submitted, then just include the council tax debt on it. And get a move on! the fact the council has gone to court for a liability order means they may send in bailiffs or get an attachement or earnings. these won't stop the debt being included in your DRO but can be a considerable hassle for you.

    If you have already applied for a DRO and it has not yet been approved, was your council tax debt included on your DRO submission? If it was, then it won't matter that the council has gone to court, the debt will still be included in your DRO.

    If you have already applied for a DRO and not included the council tax debt, you need to talk to the Debt Advisor setting up your DRO urgently about the problem,
