    But nothing is actually happening

And that might be the problem. I think tax credits tend to be quite sympathetic in newly separated couples who still live under the same roof when there is evidence that they are doing everything to physically separate. House on the market, signing up to rental agencies etc... and that of course up to a certain number of months. It is when the house has been on the market for over 6 months and nothing happening that they start questioning whether there has ever been an intention to move out.

The reality is that you are dependent on your ex to move, but he will have no financial incentive to do so, especially if you get more money yourself to put towards the bills. If he doesn't move out, or doesn't support the sale of the house (or you don't want to sale it), and he still pay nothing towards the bills, it is not HIM they will investigate but YOU.

One is the official mortgage on house other two are equity release mortgages for 2 debt consolidations over the years mainly built up by him. Bank wouldn't combine into one mortgage so we make 3 separate payments on each totalling £1400 month

    Ouch! That must hurt.
