2 parking fines, 1 sad day...

Hi,

Having gone to my Mums place last weekend I opened two letters that were addressed to me, as it is where my vehicle is registered with the DVLA.

The letters were from a company called Private Eye Parking (one I'm sure you're all extremely familiar with after reading dozens of threads!) Relating to two separate incidents on May bank holiday weekend in Cornwall. Like many of the others on this forum I was shocked at the price of the fine and the manor in which it came in.

Again like many others I racked my brains to remember to what the circumstances were and if i still had my paper ticket as proof of payment. The first is for parking at Tower Rd in Newquay, I know that my friend used my number plate and paid for the sufficient time (my only worry is that a digit or number may have been entered incorrectly) The second was up the coast at Watergate Bay (the same day!) and again I was under the impression we had paid adequately for our stay.

After reading the Newbies Sticky and looking for similar complaints I think I have worked out the landowner of both car parks.

Tower Road, Newquay - Newquay Golf Club
Watergate Bay - The Beach Hut Restaurant

However appealing to them hasn't seemed to help too much in the cases I have read? I have already replied to the PPC using the template provided by Coupon-mad in the walkthrough thread. (very helpful cheers).

I hope I have made the right decision, my experience after reading lots of different cases is that regardless of the infringement these guys are out to get you and are very sneaky about how they go about it. I'd imagine that my appeals will get rejected and I will then have to go down this POPLA route?! Seeing as I have responded within the 14 days will that mean at the end if all fails I am still liable to pay the reduced fee? Please help me beat these bandits, their whole scheme makes me sick.

    At the end of it you still aren't liable to pay anything. It's still an invoice at the end of the day...it's not a fine. Eventually the PPC may try and take you to court to enforce payment. This still rarely happens.

    Do you have a POPLA code from them?

    Okay it's Parking Eye not Private Eye as they are not involved in ticketing ;)

    You need to appeal each one individually with the appeal wording in the sticky thread, send each of them via the post office with a free proof of postage, and appeal via their site as well. When they reject come back for help with popla.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • Thanks guys as stated I did appeal to them individually but I only sent them off with a normal 1st class stamp, will they still acknowledge the appeal without a proof of postage?

    They wont send you an acknowledgment per se, but they will reject the appeal with one or two standard letters and then you will proceed to POPLA appeal.

    How would they know whether you got proof of postage?! We don't tell people to use signed-for postal methods for a PPC anyway so you've posted it correctly.

    When ever I've sent something and asked for proof of postage the post office has affixed a barcode label to the envelope, scanned it and input the address it is being sent to and then given me a receipt with those details contained on it. My point being that there would be a barcode attached to the envelope. Don't worry about it too much though. There is still an assumption in law that it will be delivered unless they can prove otherwise.
