Bank is threatening court action!

My stepson has an account which is over its limit admittedly but only because of all the bank charges constantly being added to it. He has been out of work so although the bank has asked for the account to be sorted he has been unable to do so. He is currently in the process of reclaiming his bank charges and has filed his case in the court already but now his bank has written to him threatening to take HIM to court if he doesn't settle the outstanding balance, which wouldn't have been outstanding if they didn't keep on charging him! I would say not to respond because the bank would be foolish to take hime to court over this as it could back fire on them and as he has already threatened court action with them. What would anyone else suggest?

    He needs to ring the department that sent the letter, inform them that he has already started proceeding regarding claiming back the bank charges.

    The Banks are very big organizations and often one department does not have access to details that another department has.

    The same thing happened to me with Alliance & Leicester, they stopped pestering me about the balance and even credited £200.30 back to my account, being the last 3 sets of charges and interest.
