Highview

Hi
I received a notice regarding overstaying free parking time, I sent a letter disputing, the template from here regarding bad signage and too high fee, and have just received the second demand for the full rate. I have a company car and they are sending the notices to work address not my personal address which I advised them of. not sure what else to do but send the same letter again? any advice please.

Have I read the threads correctly that after informing Highview of my details they should have reissued my PCN and not sent another to my company's address?

So you have appealed to the parking company, did you send that appeal with proof of postage ? Has your company named you as the driver ? Are they writing to you at your company or the company as the registered keeper?

I sent a letter to the company with my personal contact details as my company wouldn't provide my details directly, I sent normal post as I had read they may not accept if recorded. they are addressing everything to my company as the registered keeper

Did you specifically state you were the driver? If so then send a complaint email to the BPA using the email address for Steve Clark, shown in post #6 of the NEWBIES FAQs sticky thread.

And send another copy of your appeal to Highview, reminding them that in fact you have already appealed so they are now in breach of the BPA Code of Practice as well as general consumer law and OFT Guidelines in that they are writing to a party who are not liable (remind Highview that, under POFA2012, once the Operator knows the name and address of who was driving they CANNOT pursue the registered keeper). Tell them you have reported them to the BPA and expect a reply to your appeal (copy attached) and a POPLA code by return, or you invite them to cancel the charge.

I received my POPLA code and went to get photos of signs at carpark but have got there and they've all been changed there is a new maximum stay and signs on every lamp post. when I received my notice there was only a sign at the entrance you couldn't read as it was on a sharp bend and behind a double zebra crossing. what appeal basis can I use if I cant provide evidence of the signs please?

so even if the new signs cover the points I can still appeal on assuming the old ones didn't?

Exactly that. The onus is on them to prove they were. Quite difficult if they have since changed them!

no , because they may slip up and submit the new signs that werent there when you parked so you refute their evidence later on in the appeals process

let them trip themselves up , dont help them

in another thread (and on parking pranksters website ) they are deemed incompetent , which I agree with having seen numerous examples of it
