I have entered a DMP with CCCS
I have cancelled all my direct debits and written to each of my debtors.
Heres the problem
Egg continue to reinstate the direct debit claim, and nat west keep refusing charging £38 each time.
1. phone call to nat west.
They inform me that there is nothing they can do as the agreement is between my self and egg and that THEY are covered by the direct debit guarantee, so can continue to claim the direct debit all the time i still owe them money. I have asked the bank to not pay any further direct debit claims, but they say unless i pay for a personal banking assistant this CAN NOT be done.
2. Phone call to EGG
I have explained that i have written to them on more than one occasion requesting that direct debits are cancelled. I have also sent them my CCCS client ref number. When speaking on the phone they claim it is not them claiming the money but NAt West trying to send the money.
This can not be as i keep cancelling their reinstated direct debit advice.
3. Phone call to CCCS
They tell me i must contact each of these companies, get the bank to freeze my account (the bank tell me there is no such thing as "feezing accounts"), and tell egg not to claim any more quoting my CCCS reference, (they tell me they are doing nothing).
This is going round in circles, i am getting no where and all the while in JUNE alone i was charged £400+ in returned items charges and late payment charges.
Everyone claims there is nothing they can do about it whilst my debt is getting bigger andbigger whilst i am trying my best to make payments to everybody.
The banking ombudsman have of no help either, pretty much saying that i must contact these companies and stop them from making direct debit requests and to tell the bank that they must not pay them.
All this has been done, but it is still not stopping.
There is no one else to contact to help with this

I'm sorry to hear of this situation it sounds like its really getting to you. I think the only thing you can do is close the account. Open a basic bank account with a bank that isn't connected to Natwest or egg, which is adviseable if you are claiming charges any way. Then you are starting a fresh and hopefully this will stop.0 -
Personally I would open a different bank account and close the other one. It is best to put it in writing rather then phone calls though send recorded. I am not sure about the bank charges but I would see the CAB who will be able to contact EGG on your behalf0

In answer to your suggestions, i have already opened another bank account for my financial dealings as the NAT WEST one is in debt management with an overdraft of £2500.
So i cant actually close it untill its paid off,. Of course when they repay the charges it will be much closer to being paid off, but for the time being it seems i am stuck with it.Are you ready for this

I only had to read the first couple of lines to answer, get a different bank account right away!
One not affiliated with any of your creditors.
Just seen your reply - if you are stuck with the account then something is going wrong. Do you bank online with NatWest? You should be able to see a list of DDs somewhere, just keep deleting Egg. Then write to Egg again stating you wish to cancel the DD and write to NatWest.
I suspect this isn't Egg's doing, I've hardly heard of anyone having problems with them. NatWest on the other hand, are despicable.No longer using this account for new posts from 20130 -
I thought direct debits were cancelled by the customer with the bank, in which case you should be cancelling it with Nat West not with Egg, as a direct debit is you giving permission/authority to the bank to pay an amount each month to Egg at their request. Maybe I've got that wrong.

Anyway, you're not getting far with telephone calls, so I would write to both Egg & Nat West explaining what you have done (cancelled the direct debit), & that what they are doing is resulting in your debts being increased, without your agreement. Mention how many times you've telephoned them about it, & give the names of the people you've spoken to & dates if you've got them. I would include in the letter a statement that you are expressly forbidding Egg from seeking payment from your account in any manner including direct debit, and that you are expressly forbidding Nat West from paying any money to Egg by whatever means they may claim it unless you give them your written agreement to do so - I say that because when I cancelled a direct debit with my bank for payment on a credit card, the card company simply did a manual override & took the money anyway, making me overdrawn. I got the money back, but only after a lot of phone calls & faxes & threats to call in the Financial Ombudsman. :mad: That statement makes your intentions & wishes clear, & if either party fails to abide by them they'll have some explaining to do. The very least Egg will have to do is write to you to advise you of non-payment & find out how you intend to make payments in future.
I would send them both a copy of the other's letter, & tell them that as you cancelled the direct debit on such & such a date, you do not consider yourself liable for any increase in debt incurred after that date, especially as you have also repeatedly cancelled the direct debits Egg have tried to reinstate. Perhaps then it will dawn on themselves that the admin nonsense they're going through is not going to get them any more money than they've already got. Either way, you'll have your letter to them as proof you made them aware of the problems they were causing on the account.BSC #53 - "Never mistake activity for achievement."

I thought you could cancel dd with your bank and that was it, it couldnt be re-instated without your say so. Just ring Natwest up and cancel it with them they will ask if you have notified Egg but thats as far as it goes you have the right to cancel your dd from your account. If you change your bank account your overdraft becomes another debt that you include in your DMP and you can get the interest froze on that too.0

It is standard practice for your creditors to continue billing you/refuse to free interest and expect payments from you untill they agree a payment plan with cccs....cccs offering a payment is not the same as your creditor agreeing it, or your creditor receiving it.
But IMHO if you cancelled the dd with your bank and in writting to the company directly (per the t&c's of a dd) they are not allowed to take money out your account as this would be in effect setting up another dd and taking money without your permission - you should be refunded any money taken and any charges added because of the payment.Don’t ask what the world needs. Ask what makes you come alive, and go do it.

I will add that NAT WETS 's stance on it, is that a direct debit is an agreement between yourself and the creditor and nothing whatsoever to do with the bank, If you want to give all your account details over to a third party, thn you have to trust them to take money as and when they should and not without your written consent. The bank just action the direct debit mandate, as far as they are concerned no-one would claim money from your account without your consent.
I have asked them not to allow any further direct debits to be either set up or claimed from my account as i will deffo not be giving anyone permission to do so.

im with Natwest, i cancelled several DD's without any problem, just deleted them with there online banking system, they all stopped and none of them were ever returned unpaid..0
