We have been through the repair once with an approved samsung repair company (visual FX). We paid them £250 to supply and fit and new compressor. The compressor failed again less than 4 months later. The company would not come out to inspect the unit without charge as they only give 90 days parts and labour warranty. The independant report stated that they gas had leaked from the welded joint and is beyond repair. We have been waiting for 10 weeks now for Tesco to make a decision. We are claiming back from Tesco the cost of the repair (£250) the independant report (£90) plus the cost of the temporary fridge freezer that we had to buy on boxing day (£229). We have had to keep the broken fridge freezer also until the claim is finalised so we are unable to purchase a new american fridge freezer either as we have no space to put it. It's so frustrating that Tesco are taking so long to make the decision. How long is a reasonable amount of time to wait? I would have thought 8 weeks max. They are telling us now they are about 2 weeks behind with working cases. ARGH!!!!

Why are you not claiming from the retailer if you believe that they are liable to repair under SoGA?

Why are you claiming the new fridge and not a partial refund of the old one?

Or is the new fridge like for like in specs, age and condition? I presume not or you wouldnt be looking to purchase a new one.

I think your claim for the new fridge may be your only shaky point. As you have a statutory duty to try and mitigate your losses (ie by picking up a 2nd hand fridge)
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

If its 4 years old, then your chargeback is not going to work...

But the replacement compressor that failed was only 4 months old.
    If it sticks, force it.
If it breaks, well it wasn't working right anyway.

Still waiting for Tesco to make a decision. They have now got all the information they require and have gone back to the repair company that fitted the new compressor. It has now been about 12 weeks. We bought the new fridge freezer on Boxing day and are claiming as a consequential loss. If the fridge freezer had not broke sown again after 4 months of a new compressor being fitted then would have no need of being forced to buy one off the shelf. We would still ideally like to have an american fridge freezer but don't have any where to put it as Tesco do not want us to get rid of our old fridge freezer until the claim in sorted. So currently we have one big amercian fridge freezer that does not work and a small fridge freezer in our kitchen. Getting very frustrated with Tesco now. Why is it taking so long?

probably taking so long as your claim is unreasonable.
