Excel notice

Hi all

I noticed on the newbie thread that non-windscreen tickets NTK has to arrive by day 15 if under PoFA 2012.

If it had arrived 2 months after would this also be another ground for appeal i.e. improper conduct?

Just to give you a summary of the ticket in a supermarket car park for 30 minutes at midnight obviously well past opening/closing times.
Ticket arrived for not paying/displaying. issued by Excel.

EDIT: Also would like to add the vehicle was a courtesy car, clearly the driver has been located. Would this refute the claims of improper conduct as they can claim they were locating the driver?

EDIT 2: http:// oi62.tinypic. com/1zqdm6p. jpg
Just noticed the letter makes no reference of whether it is actually an NtK or ....

Well it depends whether they are alleging a windscreen ticket was on the car, excel do both types of fake tickets so look at the NtK to see what they are saying. As for an appeal read the newbies thread and use the wording there, send it electronically and through the post with a free proof of postage at the post office.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Hi Stroma,

They are alleging a non-windscreen ticket using ANPR cameras.
I am referring to the newbies thread as suggested however cannot locate a template for tickets received outside of the 15 day requirement.

Is there somewhere else I can find this?

As mentioned above the I received letter makes no reference of whether it is actually an NtK or ....

Just use the standard appeal, then add an extra paragraph to state that as the NtK was received outside the limits prescribed by PoFA 2012, the keeper no longer has any liability and they should pursue the driver, whose details you are not obliged to reveal. So forward a cancellation of the charge, or a POPLA code where you will make this point (as well as many more) to the assessor.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well the 'hirer family' has been located! Not necessarily the driver that day of course...but that's semantics in this situation as you need to hook it firmly in your direction.

Personally in your situation I would just use the template in the NEWBIES thread and change the 'I am the registered keeper' to 'I am the hirer'. And I wouldn't add anything about late NTK because you've presumably now been sent your own 'NTD'?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

How cheeky are Excel to send this as part of their automated response!

    2) A FULL POSTAL ADDRESS that we can correspond with, as all decisions are conveyed in a letter to the motorist.

There is no "serial number" on the letter, but rather a trap to get people to start answering these questions with the goal of the NAME of the motorist.
