Parking Ticket Appeal - Code 81

I am a new user - so can't post a link to my picture, but you can see it by looking at my twitter feed - @shep23
I hope you can help - my vehicle was parked more or less in the green area marked on the picture, and was issued with a PCN - the reason given being a code 81, Parked in a restricted area in a car park.
I have appealed the ticket on the grounds that the ticket could not be valid as my car was not parked in a car park at the time. This was dismissed by the council, saying that I was parked on a dropped kerb and restricting access for the disabled, due to the studded kerbs.
Should I continue my appeal on this basis ? A quick google reveals that some other councils elaborate on code 81, saying "The contravention occurs when a vehicle waits / is parked in a clearly marked restricted area within a car park. There will be surface markings and adjacent signage to signify the restricted area"
As these markings and signage were not there, surely the council haven't got a leg to stand on ? Or am I being too optimistic !

As this is a council issued notice I would recommend heading over to the PePiPoo forum, as they have more knowledge in dealing with these types of tickets.
You will be able to upload the images, so do so when posting. Make sure you load up any pictures of the site and the front and back of the ticket (obscure any personal/identifiable information).0 -
