Late last year we recieved a letter from Northampton County Court to say that there had been a judgement filed against us for a parking offence 2 years earlier by a company called PCN Northwest, we have recieved nothing! there was never a ticket! we have had no letters or correspondence off anyone, the first we heard was this.

I wrote back to the court saying this is the 1st we were aware of any offence committed, this was 5/6 weeks ago.

Friday 16/5 we recieved a GENERAL FORM OF JUDGEMENT or ORDER stating that we must pay PCN NW £416.66 how can they get away with this?

I spoke to a friend who said i should apply for a notice to be "Set aside" but the court wants a further £155 for this? please can someone tell us what we need to do Please.

    You're going to have to be more detailed than that I'm afraid. I'm assuming that what you actually received last year was a claim from PCN NW via the MCOL system run out of Northampton Court ?

    I also assume you then ignored these court papers ?

    I then assume, as you ignored, you have now received the judgement notice as you've now got a CCJ.

    If this is the case then your friend is correct, you need to apply to have the judgement set aside ( or pay PCN NW ) but that will mean you have to pay the fees. If you then go and win the case then you would get the fees back from PCN NW.

    Moral of the story ? NEVER ignore court papers.

    If you pay the £155 to apply to have the original judgement set aside, then there is no guarantee it will be set aside. You will have to convince the court that there was a genuine reason for you not knowing about he case. For example, perhaps you were travelling overseas for a long period. You may need to argue you weren't served, and the other party may dispute this and argue that you were. If you are successful in setting the judgement, then you probably will have a reasonable chance at the re-hearing of the parking charge. But the biggest hurdle will be getting the judgement set aside. Read more here.

    Do you mean you never submitted any actual defence? And so you can only pay the £155 to apply to get it set aside, so you can defend. Or put up with the CCJ as you didn't submit a defence.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
