Vehicle Control services ltd- PCN !!

Hello.

I am looking for some advice.

I've recieved a PCN ticket on my car in a parking area or a friends flats. I was not aware this was a controlled area as there we no signs on the entrance and it was dark. There are a few signs dotted around but obscured by vehicles and lack of lighting.

The ticket stated the charge for parking in somebody elses bay

I have read you information and have waited for the NTK which I have recieved . I have copied your letter to send as an inital appeal.
My challeneges the signs are not correct , i have photographic evidence that there are no sign upon the entrance to this area. The ticket states a place that does not exsist according to google mapping . It does not state the actual address or the road name .

My main question is there are discrepancies between the PCN and NTK. Do I use these now or wait until they reject my appeal and use it for the popla one? As upon your advice i do not wnat to phrase as the driver ?
The NTK states differently from the PCN
Place name slighty different again
The time of offence is later
The offence , parked in a restricted area is different to one on ticket

    Don't worry about the discrepancies as they will hold little relevance in your appeal. You have the NtK so use the appeal wording in coupons thread to appeal it, just get a free proof of postage from the post office. When you get the rejection come back here for help with popla, don't do it alone.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I would save the discrepancies for POPLA where you can have an additional paragraph (on top of the usual no GPEOL and no contract/standing) that says why the NTK isn't compliant with para8 of Schedule 4 of POFA2012. You'll win in the end.

    They should NOT be telling you that you need to name the driver to appeal - Paragraph 6.

    Do they?

    Yes they are or asking you if you are appealing on behalf of the driver to name them, and to supply a written statement from the driver giving their permission for you to act on thier behalf.

    Complete garbage, the registered keeper can deal with this, they don't need permission from the driver, and vcs most certainly don't need that information. The dvla has given orders on this subject so you should complain to them.

    • Asking the motorist to enter into additional correspondence to obtain a POPLA code
    • Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
    • Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
    • Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “

    Ensure you scan the letter in from vcs and email both the dvla and bpa, both addresses in post #6 of coupons thread
