Is it worth taking them to court?

Hi all,
We had a paved driveway fitted by a local building company about six months ago and it has already begun to sag.
I have called and left messages many times, written to the local address he gave and then the registered business address but have had my recorded letters returned. He is still trading around the town.
I was wondering whether it is a waste of time and money to take him to court? The company is a limited company with two directors - one of which lives locally and their registered address is a London mail forwarding one.
What I really want to know is - is it worth taking them to court, or a waste of time and money? I am sure we would win but is it more than likely that we won't get any money anyway and chalk this up to experience? Is it better to just warn others off the poor customer service?

I should have known when he never answered his phone before but always phoned me after I left a message.
I have found out that he has been involved in companies for the past few years (with similar names) and started this company last June. My worry is he will just claim insolvency or something like that.
If I decide not to go to court then I will set up a blog/web page detailing the ins and outs with a warning so if others search for the company or directors they know to be wary - surely it is not slander/libel if it is all true and I can prove it.0 -
If you post now on rip off report it can't be removed.
I suggest you also look on companies house and find his company number then google the company number with the words company and director. Also try googling the company name number and word gazette to see if there are insolvency proceedings.0 -
You can post the company's name here it's not slander it's simply stating a fact.
If they are alleged serial " phoenixers" they need to get their name on the net- it's probably allready there.0 -

They completed a job with one of our neighbours with no apparent problems and I did search on the Internet to check there were no outstanding problems with them listed there.
I think we really wanted to get our drive done before the winter so maybe you could say we could have done more checking. ( It might be that he simply hasn't got my messages but I don't thinks so - especially as he is so hard to get hold of.)

I guess you've answered your original question then - it seems there is no point taking him to court.
Of course, if you're on good terms with a neighbour you could get them to phone up, arrange for him to come out and give a quote for something, then have words with him while he's there.0
