EXCEL Parking.....Enforceable? Photo Of 'Driver taken!

Received a parking ticket yesterday from Excel...The car park had been unmanned for months (most people in town parked with no ticket and have never got charged), however they've recently resurfaced it so I parked there yesterday I put an hour on the car.
returned to the car after the expiry time, and a van had come in and started to issue the tickets. The warden was lovely (now I know why I think), and said 'look have you been delayed?' I said 'yes as our meal had taken a long time to come' (not true, I genuinely had just forgotten about it!). He explained there was an appeal procedure, and told me to go online when the ticket hits their head office on Monday.
Now, this is where I *think* i'm going to come unstuck........He made some notes in his book, and asked me to sign it. So I did. As he knew I was going to appeal, he then asked me to hold the ticket, and take a photo of me with ticket.....Yes I know...It's only just clicked with me this morning.
Now, I don't think there is a sign in the car park, i'm going to go and recheck today....But where do I stand? Anyone?

Taking a photo has no evidential status in private parking. Even in legit parking, photos are the very bottom of the evidential food chain and only considered after everything else has checked-out.
So stop worrying and have a careful read of the Newbies Sticky - All your options for seeing them off are outlined there. Having signed something probably won't be an obstacle as the winning arguments at POPLA do not normally involve your individual circumstances. Post back here for any further help/advice.0 -
Thank you! I'll have a read tonight and appeal it....Am I right in thinking that I should admit to being the driver?0

He got you to pose for pictures with the fake ticket :rotfl:seriously they really are nuts these people! It has no bearing at all on anything, all they got is random picture of someone holding something. Just appeal when you get the notice to keeper using the wording in coupon's sticky thread. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

No more stupid than Parking Eye asking motorists to prove they haven't broken their T&Cs . How can you prove a negative? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
It's probably best to wait for the Notice to Keeper and appeal as keeper using the templates on the Newbie thread, first to the parking company and then to POPLA when the first one is rejected. If you gave your name and address when issued the ticket, the advice might be different though.
Post back on this thread if you need with the POPLA appeal. The forum has 100% success rate with forum assisted POPLA appeals.
In the meanwhile can you delete your posts off the newbie thread? (Click on edit and then delete) it keeps it tidy and although a moderator will do it, it saves them effort.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.0 -
What a sneaky git! He thinks he's being clever with a photo of the driver and a signature.
But you will win on 'no GPEOL' anyway at POPLA! Read the NEWBIES thread to understand the acronyms & to find the template first appeal - no need to change it, who cares if they know who was driving?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
