  • The war Pensioners ' mobility Supplement' which pays for the vehicle is treated on its individual merits. Ask the people [see below] who matter. The War Pensions Agency should be notified [Change of circumstances - Hospital admission] immediately, when a customer is admitted to hospital.

    I spoke with the Service Personnel & Veterans Agency on behalf of my dad yesterday afternoon. They confirmed that as he doesn't receive anything that is affected by being in hospital, his war pension payments are maintained and that mum can use the car indefinitely to visit dad in hospital.

    That's good news.

    I think we (including the social worker!) were all assuming that your dad was receiving the mobility component of Disability Living Allowance where the 'rules' are different.

    Not to worry. Glad you got it all sorted.

    Has anyone had to hand their Motability car back? my husband will get to his first week in hospital after the 28 days and should be out before another full week is up. will I have to hand the car back for a week? will I get it back when he is home or will I have to start over with another car? I am worried about it and will make all the phone calls tomorrow. I have already informed DWP and DLA. it would just be nice to know what happens. Please help if you have been in the same position.

    motability are pretty flexible about things like this.
    give them a call, but i would be very suprised it they decide to take the car

    Failure to inform change of circumstances

    Thousands have had to hand the car back, other thousands have not. As you can see from this and other threads on the subject Motability / DWP / WPS etc are very flexible and indeed accommodating. The 28 day rule is legislated and should be, but is not, common knowledge, what is definitely not common knowledge is that the hospital is mandated to inform the DWP [Motability's actual paymasters] when the 28 day 'clicks in. My writings on this subject are to warn of the one fly in the ointment that is of itself capable of causing untold grief.

    That fly is "change of circumstances" failure to inform by the client is the single most common reason used by the DWP to take action after the 28 day period. This in conjunction with the hospital trusts pre-requirement to inform the DWP makes it look as if you have deliberately failed in your duty to inform the DWP of the change of circumstances. So don't be afraid to inform, they are going to find out anyway, better it comes from you. As you will see from this thread handled properly most agencies will go a very long way to exercise discretion in favour of the disabled.
