    How can you prove you didn't get something ? Sorry but it's impossible ! And you misunderstand me, I don't say to let it go to court to try and get a popla code, the point I was saying that district judges have ordered it back to popla, that is a distinct difference!

    And the whole point and the reason to get proof of postage on the appeal is to prove that it was sent, legally it's deemed served after two working days unless proved otherwise. Writing to them when they are supposedly considering the appeal serves no purpose IMO and is a waste of a stamp or cyberspace. They don't need reminding!

    And I have seen people out of time at popla, those are the ones who have had a code and not used it, those are the only ones out of time, because as I said an operator can issue a code at any time, in fact they could issue a second popla code if it runs out.

    As for a paper trail, one already exists by writing to them initially, providing you have a copy of it and the receipt of postage nothing further needs to be done but wait for the ppc to respond, or if they have conveniently lost the mail a debt collector. But again you have the audit trail.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    This is all good stuff. I guess the only slight difference is that it was emailed and the only proof i have is the sent email in my 'sent items' mailbox. Whilst i asked for a delivery and read receipt nothing has come through. Hopefully this doesn't change anything?

    I noticed ColliesCarer suggested writing now to the PPC (before the 35 days are up), so am assuming there are different ideas on this.

    I advised responding stating an acknowledgement had not been received and to include a copy of the appeal because under similar circumstances it is what I would do to try to head off the possibility that they may claim an appeal was not received.

    In addition - if the OP appealed shortly after receiving the PCN then a letter now copying in the original appeal (and the email used to submit it) may have a chance of arriving within 28 days of the PCN and would ensure they would find it very difficult to get away with denying that an appeal had been submitted in time.

    But I would advise sending it by both email and mail and getting a free certificate of postage this time. I would also add a line to the letter stating that it had been sent with proof of posting obtained.

    Why not enclose a printed out copy of your email when you chase this up, and this time use ordinary 1st class post with a free cert of posting from the PO counter (NOT 'signed-for' delivery). That way they can hardly deny receiving an email and a posted letter.

    Ok, so just thought i would raise this. it currently stands at 40 days and still nothing received following my appeal letter (send via email).

    I will be firing off an email tomorrow and follow it up with a posted letter (which contains my original email).

    but what are the implications of them missing the 35 days they state on their website? is it wishful thinking to assume they are dropping the case? :D

    I wouldn't bother if it was me, just wait to see if they write to you out of time, you can prove you have appealed they are in breach of the CoP by not replying to that appeal.

    Repercussions = nothing. Just wait. It took one PPC I appealed to, 2 months to come back saying they'd cancelled it recently. I was most disappointed as I was already planning my POPLA appeal!
