My husband has an IVA and HMRC are forcing him to sell our home.
Is there anyway we can appeal?
We were originally told that, rather than going down the bankruptcy route, he should take the IVA option as he would be less likely to lose his home. That we could pay the debt over two years.
Our 5year old is terrified of leaving her home and we are too.

I'm guessing a bit here. Are the following statements correct?
- Your husband had a large tax debt (how large?) and other unsecured debts (how large?).
- In order to be able to repay the tax debt over 2 years, he took out an IVA for the other unsecured debts
- HMRC had not agreed the 2 year repayment proposal when he took out the IVA
- you have a house with a lot of equity in it (how much?)
If they aren't correct, could go into detail please.

re your child, you need to both change your attitude to this problem. Your child is reacting to YOUR fears. Small children are not attached to bricks and mortar in the same way that adults are. If you have to move house, then there will be some good things about the new one that you can sound enthusiastic about to her - it will be closer to her school, nearer to a park, right by a bus stop, close to one of her friends, near to grandparents and gran makes such nice cakes, there will be a tree right outside her window and there may be squirrels in it,etc etc..
You need to stop talking about adult money worries in front of her - tell her they have been sorted if she asks. Say you love the new place because its got such a funky coloured avocado bath (yuk!). This is one of those times when as parents you have to lie through your teeth to your child.0 -
You need to speak to your ip and get them involved, if they have excluded the Hmrc debt from the iva so you are making separate payments to them on top of your iva then well yes, Hmrc can move the goalposts and do what they like really, it would have been much better to have included that debt in your iva at the start.
Oh and I agree with the above, you really shouldn't be loading these problems on a poor 5 year old for goodness sake! I am in an iva, 3 years in and my now 11 year old has absolutely no idea, that's how it should be.Aug GC £63.23/£200, Total Savings £00
