Fraud of signature on guarantor agreement!! Help?!

    Section 4 doesn't arise here as the abuse your position you have to be in a role that "occupies a position in which he is expected to safeguard, or not to act against, the financial interests of another person". That's not the case for a private individual but is the case for a solicitor, for example.

    However, part of section 2 is that the false representation is "to cause loss to another or to expose another to a risk of loss." The forged signature exposed your husband to a risk of loss so an offence was committed even if no loss ever took place just by forging the signature.

    I'm not surprised the Police weren't interested but these types of offences must be reported to them as well as Action Fraud:
    • Making, supplying or possession of articles for use in a fraud
    • Possession of false documents
    • Making off without payment – fuel only
    • Forgery or use of drug prescription
    • Fraud, forgery etc associated with vehicle or driver records
    • Other forgery.
    I would get in touch with the Police again and make it clear that you are reporting a forgery. In the meantime, wait for the court case to continue.
