Parking Fine

Hello,


I have come to the forum after reading the stickies regarding what to do in response to a parking fine I have received.


Upto now I have had three letters, two from Euro Car Parks and one received today from Debt Recovery Plus. One of the letters sent by Euro has "NOTICE TO KEEPER" marked at the top. I have not replied to any of the letters but after reading this forum it appears that I should send an appeal against the PCN.


I just wanted to check a few things before I do it.


The first thing I was a little unsure of is the appeal itself. I have read the template provided, this should be sent to DRP?


Should I copy the entire template?


Apologies for another thread but I wanted to make sure I do things correctly.


Any advice on dealing with this would be gratefully appreciated.

    It is not a fine so please don't use that term on this forum.

    Your appeal should be directed to the Parking company.

    Use one of the template appeal letters that is closest to your situation. Only use the winning defence points of no standing, not owning the land, no GPEOL, and bad signage. Don't bother with mitigation as it won't work.

    You should write to DRP telling them that you deny the debt, they must refer the incident back to the principle (the PPC) and any further contact from them will be seen as harrassment.

    The regulars encourage posters to learn how to navigate around the forum as there are hundreds of requests for help averyday and it would be impossible to help everyone by spoon feeding them information when it is readily available in one place.
    You seem to have the main grasp of things, but please post up your appeal here when you have drafted it for the experts to check it out before sending it. Leave out personal details, reg numbers, document numbers etcetera because the PPCs monitor this site and could identify you if you aren't careful.

    It's not a fine but you are too late for POPLA (so what though...it's only ECP!). What about a complaint to the landowner/retailer as per the 'Successful Complaints about PPCs' sticky thread? Loads there about places like Sainsburys rushing to get this drivel by ECP cancelled when customers have complained.

    ECP up to now have only tried going to court on 1 occasion.

    They usually just churn out empty threats via debt collectors.

    You could try to appeal to ECP, even though they might say you are too late. But it's never 'too late' to be given a POPLA code. It may be a harder job to get one out of them, but persistence (and complaints to BPA/DVLA if they won't) can pay off. Then on to POPLA with a template based appeal.

    In parallel complain to Lidl.

    As a fall-back, you're in the position you are now, being chased by debt collectors who are powerless in this context. If they pass the file back to ECP and ECP issue a LBCCC/LBA come back to us.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
