Parking charge notice for 17 seconds....help needed

Hi

I was in uxbridge and went into some private land to turn around and drop money off to a friend.

Today I received a parking charge notice from park direct uk showing two pictures of my car in different places at 19.04:12seconds and one at 19.04.29 seconds. They have requested payment of £100!!!!

They also state the contravention was at 19:05 hrs?

I have sent an appeal letter to them and expect a rejection letter as many people state they send these out.

Looking ahead is this worth appealing with popla?

Any help appreciated, p.s I am new to the forum so just learning

    Of course you appeal to POPLA - but I hope in your appeal to Park Direct UK you didn't write in the first person saying I did this and I did that - as per the first line of your post.

    Better they remain in the dark as to who was actually driving on the day in question.

    Letter not posted yet will amend it to third person eg the driver only waited 17 seconds...many thanks

    I wouldn't even mention the waiting. Their 'claim' is based on you parking and 2 photos 17 secs apart showing the car in different locations is definitely not parking.

    I agree with !!!!!! - 17 secs driving in and out again doesn't = waiting. I would also suggest you send the 1st appeal template letter that you will find in NEWBIES sticky thread

    As Mentioned use the template on the newbie thread. But you may want to add an additional appeal reason referring to section 13 of the BPA Code of conduct which they clearly breach regarding a grace period
    13 grace periods
    13.1 Your approach to parking management must allow a driver who enters your car park but decides not to park, to leave the car park within a reasonable period without having their vehicle issued with a parking charge notice.
    13.2 You should allow the driver a reasonable ‘grace period’ in which to decide if they are going to stay or go. If the driver is on your land without permission you should still allow them a grace period to read your signs and leave before you take enforcement action.
    13.3 You should be prepared to tell us the specific grace period at a site if our compliance team or our agents ask what it is.
    13.4 You should allow the driver a reasonable period to leave the private car park after the parking contract has ended, before you take enforcement action.

    Hi

    Well today I receive a 2 page letter basically stating the signs are clearly displayed, the parking charges are in accordance with para's 19.5 and 19.7 of the BPA.

    They justify the costs saying if motorists didn't"park" where they shouldn't then they wouldn't have to look after the land, very strange.

    For the grace period they state they have 1 minute grace period. they have now provided another picture of my vehicle before it left the site so total time is 19:04:14 secs to 19:05:04 secs, so still not even 1 minute. They state their pictures provided support the one minute when they clearly don't.

    It then gives me a verification no. and standard refusal of the appeal

    Any help now appreciated should I appeal to POPLA, if so what should I say……all help so far greatly appreciated

    use the popla code (check its valid) and check the popla appeals links in the NEWBIES sticky thread

    also use the search tool to find similar appeals on other threads and plagiarise those that were deemed suitable for submission to popla

    I believe the BPA would state that 5 to 10 minutes is deemed reasonable to comply or leave, am sure a judge would say so too , so complain to the BPA about these jokers and enclose copies of the paperwork

    also complain to the landowner too , but get the popla appeal done first

    And keep that same extra point in the POPLA appeal. It so nonsense to suggest you a
    Can park, leave your car, lock it, go over to the sign, read all of it , decide not to park, return to car, get in and leave car park all within one minute. I can't imagine any court in the land let alone POPLA accepting this.

    So get writing POPLA appeal and send off. And yes complain to a BPA . Details of BPA in post 6 of Newbies thread.
