    I was also under the impression that the S21 notice was an evicition notice that is only served if the tenant refuses to leave, (after the 2 months notice from the landlord/request to leave.)

    Guess you learn something new every day. Didn't know the S21 was just the 2 months notice.

    The S21 Notice is the only legal way a LL can give the 2 months notice. A letter giving 2 months notice is nothing more than a request with no legal force or meaning.

    If the tenant did not leave after such a letter, the LL would then have to serve a S21 Notice giving another 2 months!

    S21 can be served any time after the start of the tenancy.... most often these days when they're giving the "notice". The notice period is for two full rent periods, so takes effect from the following rent date (which might be 2 months' time if they got it right, or might be 3 months -1 day if they farqed it up).
    The LL can serve a S21 (1)(b) giving 2 calender months notice. This applies both during the fixed term, and during any subsequent periodic (SPT) tenancy. See [FONT=&quot]Spencer V Taylor[/FONT][FONT=&quot] .[/FONT]
