    Hi Coupon-mad. I'm just wondering if you can tell me what is different here to normal that makes it a tricky one? What is it about this scenario that makes GPEOL harder so stand-up?

    Is it a combination of :
    1. The signs designated the parking exclusively for a particular retailer; and
    2. They had announced his registration number & asked the owner to come forward, and the owner didn't come forward.

    It's where a PPC operates mostly at residential or business car parks, with a contractual fee model with signs that say 'you agree to pay a fee for parking here and you are very welcome to park without a permit here for the price of £100' or whatever. Not many firms use that model, partly as they have to pay VAT on such a service offered, partly because they don't understand it and partly because it doesn't suit lots of car parks. For example, if customers of a retailer read those terms they'd turn tail and never return. You cannot argue no GPEOL without first dismantling the guise of the 'contractual fee' just being smoke & mirrors to hide a disguised penalty.
