Private parking ticket advice needed.

Hello,

Quite new to this site, so apologies in advance if I state something wrong.
A couple of weeks ago my husband parked in a private car park in Oxford designated for people using a particular grocery store.
He was going into the grocery store to do some shopping but had to get cash before he went in, so parked at their car park & ran across the road to get cash. Then he went back in to the grocery store to do some shopping & when he came out, their was a parking ticket on his car issued by a private firm.
He spoke to the staff at the grocery store & they said they could not do anything about it. They had announced his registration number & asked the owner to come forward (this happened when he went to the cash machine)& since no one came forward, ticket was issued, we have parked there many times & always shopped there, never seen a sign suggesting we need to get a permit from the store before parking, they have added a sign recently & through habit just didn't look at it properly.
Anyway came back home furious & vowing never to go back to that store. Read a few threads here & although most of it suggested to ignore the ticket. Read a few that said that we shouldn't ignore if its a lease car (we have a lease car), so wrote to the company using the template letter provided here & refused to pay the ticket.
They wrote back saying if we don't pay in 5 days, the charge would go up.
They are a BPA approved company.
Any advice on what we should do next would be greatly appreciated. Do I write back? Ignore or appeal through POPLA?

Thank you in advance

    Grocery store is ?
    Parking company is ?
Do you have a POPLA code already ?

Couple of points - there is NOBODY in the first 100 or so pages on here that would have recommended ignoring unless you are in Scotland or NI so I've no idea where your husband read that.

Secondly, "BPA Approved Company" ????? The BPA is a cosy den of thieves - they don't "approve" companies, they just accept anyone that has paid their membership fees.

If you appealed and they didn't give you a POPLA code then complain to the BPA. All this is in the newbies thread.

OK - you need to get on this as CPS aren't a very pleasant PPC.

You need to write back and demand a POPLA code as per the BPA CoP. Copy in Steve Clarke at the BPA ( his details are in the Newbie thread ) and mention that you wish to make this complaint a formal one.

Got your PM but while there isn't any need to keep things private I'll answer your questions in this thread as it will help others in your situation

Oh, this will be interesting! Perky's lot! Don't send a generic POPLA appeal, you'll need help with this one and we haven't seen one on the forums for over a year and it was lost at POPLA (but then that was before we learnt more...).

Keep the thread updated and don't reply to pm's offering to 'help' you, unless they are from regulars with hundreds of posts to their name!

Have you got a POPLA code? I will try to help you so send me a pm as soon as you have a POPLA code.

Could you send me a pic of the PCN and the signage, and all the replies you get, and also a copy of the appeal you sent (did you change it to say 'I am the keeper/driver' or what?).

    Is it this place:

    http://oxford.openguides.org/wiki/?Tah!!!!mid_Stores (remove the !!!! )

Do they have parking round the back then? I know Cowley Road very well as my DD is at Oxford & lives nearby (and no Perky, that doesn't narrow my identity down!).

  • I will message you the PCN and signage as soon as I get home form work & also the letters.
Ya Ta!!!! Stores in Cowley Road has parking on the side & has a sign stating its for their customers only, which I clearly was.
    Thanks again.

Hi Coupon-mad. I'm just wondering if you can tell me what is different here to normal that makes it a tricky one? What is it about this scenario that makes GPEOL harder so stand-up?

Is it a combination of :
    1. The signs designated the parking exclusively for a particular retailer; and
    2. They had announced his registration number & asked the owner to come forward, and the owner didn't come forward.
